If an infringement of your copyright registered work is identified, the next step is to ask the infringing website administrators to remove the relevant material quickly without having to go to court.

The practical application of this, is a takedown notice, which is a formal request to anyone who is using your work without your permission to take it down immediately. Whether it is a search engine, a host of content or really anyone who publishes unauthorized work, they have to comply with the take down notice and remove the requested content. If the person doesn’t comply, you then have the option to take further legal action.

CopyrightsWorld provides both take down notices and court-ready reports. Please speak to our customer support team for further information on how to access them and the formal ways of using them.

When you post on social media you are actually sharing your creations with the rest of the world. And the truth is that we all do this, all the time. Surveys show that every second, more than 995 photos are uploaded on Instagram only!

But along with all this tremendous exposure come many questions: How safe are your posts on social media? How can you know if someone uses an image of yours without your knowing and without your permission? How can you own your posts?

That is why we created Social Protect!

Social Protect is our new feature that enables you to own, protect and monitor your original social media content simply by using #cwprotect every time you post something on social media.

The procedure is simple and easy! All you have to do is follow these steps:

Create your account with CopyrightsWorld. All you need is your email address and it won’t take you more than 30’’. You can start for free here

Log into your CopyrightsWorld account and connect all your social media accounts (Facebook and Instagram).

Use #cwprotect every time you post on social media. We automatically upload your post to your CopyrightsWorld account and create your certificate of Copyright Ownership, which you will soon receive with an email. Also, our monitoring service is activated. This way, you can keep track of who -from anywhere around the world- uses your posts without your permission.

In the next video you will find a step-by-step guide of how you can protect your Facebook and Instagram posts:

Firstly, let’s establish exactly what a “copyright” is. To give it a legalese definition, copyright is a person’s exclusive right to reproduce, publish, or sell their original work of authorship. In other words, it’s pretty much a certificate proving your ownership of a creation.

Examples of works that require a copyright, include: photographs, literature, music, dramatic or otherwise artistic works, as well as architectural work. There are of course more and more copyrights created every day that do not fall into any of those categories: logos, technological hardware, programming code.

What does holding a copyright allow you to do? Basically, anything:

Reproduce your work

Build or take away from aspects of your work. In other words, create derivatives

Sell you work to the public

Perform your work (if applicable)

Display your work publicly

Although holding a copyright will protect your expression of ideas, it cannot protect an idea in and of itself. For instance, taking a picture at a common scenic spot entitles you to a copyright of the image you took; it does not, however, give you a monopoly over who may or may not create their own reproductions of that same scenic spot in the future.

If you wish to make a profit from your work, you are free to license your creations out for commercial usage. This will allow you to collect revenue without losing ownership of your copyright. In order to formally create such a commercial relationship, it is crucial to have a licensing agreement in place that outlines the exact terms and conditions of usage. As such, the key benefit to owning your copyright is that you are protected by the law against illegal usage… and, of course, you can make money off your work if you so wish. Tools like CopyrightsWorld’s Infringement Monitoring ensure that you are immediately notified of any potential unlawful usage of your copyrighted work.

The “poor man’s copyright” refers to the practice of mailing a sealed envelope to yourself containing your original creative works. Instead of opening the envelope, you keep it closed. When someone uses, copies, or distributes your work without permission, you can present the sealed envelope as evidence of ownership.

Such a sealed envelope can be easily manipulated, either by carefully opening and closing again, or by altering the date stamp on it. Both practises have been performed in so many cases in the past, that has weakened this practise to the extent of no validity. So, poor man’s copyright may be a cheap way, but it’ s not an effective way to prove your ownership in a court of law. And of course, It does not in any case, serve as a substitute to registering your copyright.

This is also validated by The US federal copyright office which explains on its website, “The practice of sending a copy of your own work to yourself is sometimes called a ‘poor man’s copyright.’ There is no provision in the copyright law regarding any such type of protection, and it is not a substitute for registration.”

At the same time, the United Kingdom Patent Office says: “a creator could send himself or herself a copy by special delivery post, leaving the envelope unopened on its return. A number of private companies operate unofficial registers, but it would be sensible to check carefully what you will be paying for before choosing this route. It is important to note that this does not prove that a work is original or created by you…”

To be sure that you have indisputable evidence of copyright ownership that can stand in court and protect your rights, we suggest that you use a secure and validated way to obtain evidence of ownership. In addition to an indisputable proof of ownership, CopyrightsWorld can provide worldwide infringement monitoring services and tools to act to protect your rights upon infringement .

The public domain includes all creations that are not protected by intellectual property laws. Once a creation enters the public domain, anyone can use it, for any reason, without the need for permission. It belongs to the world.

A work can enter the public domain for a number of reasons including the following:

The duration of the copyright expires: In most countries, a work created by an individual is protected for the lifetime of the creator, plus 70 years. If it is created anonymously, pseudonymously, and for hire, it is protected for 95 years from the date of publication – or 120 years from the date of creation – whichever is shorter. Once the copyright expires, no intellectual property exists, so the creation enters the public domain.

The copyright owner makes it publicly available before the copyright expires.

The copyright owner fails to follow copyright renewal rules: The need for a copyright renewal depends on when the work was first copyrighted. Works created after 1978, are not subject to renewal registration. In 1992, copyright laws were amended, making renewal registration optional for works between 1964 and 1977. Only works originally copyrighted between 1923 and 1964 need to file a renewal application and pay a renewal fee in order to remain copyright protected.

The work isn’t fixed in a tangible form: Any work that hasn’t been written or recorded by its creator, isn’t protected by copyright and therefore is available for anyone to use, alter or copy.

As copyright laws may vary among countries, always have in mind that, if a work is in the public domain in one country doesn’t mean that it is everywhere in the world.

For example, the duration of copyright protection may be different among countries. Although a work may be in the public domain in the US, somewhere else in the world it may still be protected by copyright.
